We have raised concerns with the government regarding:

 

  • the ambiguity of the transitional arrangements concerning current Part 3A applications;
  • the current ambiguity as to where applications for private sector residential retail and commercial development of $100 million plus value should actually be made (at the present time the Major Development SEPP has not been amended, so councils and joint regional planning panels lack jurisdiction); and
  • the apparent absence of interim reforms to mitigate the impact of the decision to deny access to Part 3A to new applications.
