Changes to the Standard Instrument

The Government has made some minor amendments to the Standard Instrument. These changes include:

  • A new ‘temporary use of land’ clause which allows development consent to be granted for the temporary use of a dwelling as a sales office for a new release area or a new housing estate. The clause applies immediately to any area with a Standard instrument-compliant local environmental plan in force. It will apply in other areas once the Standard Instrument comes into force.
  • “Canal estate development” has been removed as an expressly prohibited development in Zone W1 Natural Waterways and Zone W2 Recreational Waterways.
  • The definition of “entertainment facility” no longer expressly excludes “nightclubs”.
