Before any activity that is likely to have an impact on aboriginal objects or places can proceed, the NSW Department of Environment, Climate Change and Water (DECCW) must first issue an Aboriginal heritage impact permit
DECCW has published Aboriginal Cultural Heritage Consultation Requirements for Proponents 2010. It is supposed to provide a clearer process for proponents. The government says that the guidelines will enable the applicant to determine who has the appropriate cultural knowledge to determine the significance of aboriginal objects.
